ABC of copyright launches in Latin America

EIFL welcomes the launch of a new free, open and online Spanish course  internetactiva.net/cursos/abc-del-derecho-de-autor-para-bibliotecarios-de-america-latina “ABC of copyright for librarians in Latin America”  or  internetactiva.net/cursos/abc-del-derecho-de-autor-para-bibliotecarios-de-america-latina “ABC del derecho de autor para bibliotecarios de América Latina”.

The course, which launches on 4th June 2014, is aimed at the library community in the region and is designed to strengthen understanding of basic copyright concepts through examples and analysis of Latin American case law and legislation.

The material was adapted by the karisma.org.co Karisma Foundation, in collaboration with national chapters of Creative Commons in ColombiaEl Salvador and Uruguay from EIFL's Copyright for Librarians curriculum. It is available online through the School of Open for anyone who wants to take a self-guided course. Between June and August 2014, guided tutorials will be offered through the  internetactiva.ne  platform.

WHY A MODERN SOCIETY NEEDS TO DEFEND LIBRARIES?

Global debates are defining minimum conditions that will affect the right of access to knowledge and culture, due to unbalanced copyright protections. Library users, libraries and librarians should be trained to defend them.

Public library seeks to provide equal opportunities in access to information, knowledge, recreation, culture, education, reading and writing for all their users. However, there are currently no  karisma.org.co minimum guarantees that allow libraries and archives (karisma.org.co/?p=4150) carrying out activities related to their mission such as lending books or changing the format of a film (e.g. VHS to digital) for preservation purposes. For decades, protections for authors and/or rightsholders have been increased, while the guarantees of access and inclusion of copyright balances are at the mercy of political will.

This imbalance occurs especially in developing countries, as many developed countries have already generated standards seeking to better balance copyright. Facing this reality, the World Intellectual Property Organization (WIPO) is discussing the need to implement guarantees to ensure that libraries and archives can legally fulfill its mission of providing access to knowledge, culture, education and science, as well as preserving cultural heritage.

Despite the evident need, the discussions are complex: on the one hand, countries like Brazil, Ecuador and Uruguay of the Group of Latin America and the Caribbean (GRULAC) show the imbalance in their proposals, while the European Union countries, for instance, are trying to block the discussion in order to compromise other countries with a mandatory solution for libraries.

Amalia Toledo, Karisma Foundation's researcher and who has attended the last two meetings in Geneva, said that “Civil society participation is an oversight work around the discussions and decisions that are taking place internationally, as directly affect the exercise of the fundamental rights of all of us." 

The international discussion makes clear that both librarians and users, and top management of libraries and archives should strengthen their knowledge on copyright and challenges posing for the circulation of bibliographic information in the 21st century.

Thinking of this,  karisma.org.co Karisma Foundation, in collaboration with national chapters of Creative Commons in ColombiaEl Salvador and Uruguay, came together to work on a course aimed to the library community in the region. The free, open and online course  internetactiva.net/cursos/abc-del-derecho-de-autor-para-bibliotecarios-de-america-latina “ABC of copyright for librarians in Latin America  is a tool designed to strengthen the understanding of basic copyright concepts through example, analysis and openness model, based in Latin American cases and legislation. The material, adapted from EIFL's Copyright for Librarians, is available online through School of Open project for anyone who wants to take a self-guided course, or wants to take advantage of tutorials that will be offered between June and August through the, internetactiva.net  platform, where it will be officially launched.

WHO CAN PARTICIPATE IN THE COURSE AND TUTORIALS?

Librarians, university researchers, teachers, producer of educational content, students of information science and/or librarianship, archivists, museum curators, persons interested in cultural preservation projects and, in general, persons interested in libraries and copyright.

WHERE WILL IT BE HELD?

 is part of the global platform School of Open, coordinated by Creative Commons and P2PU, and will be online since June 4, 2014. The official launch will be done through the internetactiva.net platform on the said date at 1700h (Colombian time | UTC-5).

¿POR QUÉ UNA SOCIEDAD MODERNA NECESITA DEFENDER LAS BIBLIOTECAS?

Debates mundiales están definiendo condiciones mínimas que afectarán el derecho al acceso al conocimiento y a la cultura, por cuenta de la protección desequilibrada al derecho de autor. Usuarios de bibliotecas, bibliotecas y bibliotecarios, deben capacitarse para defenderlas.

La biblioteca pública busca ofrecer igualdad de oportunidades en el acceso a la información, conocimiento, recreación, cultura, educación, lectura y escritura para sus ciudadanos. Sin embargo, actualmente no existen lasmkarisma.org.co  garantías mínimas que permitan a las bibliotecas y a los archivos (karisma.org.co/?p=4150) realizar las actividades propias de su labor como prestar libros o cambiar de formato una película (de VHS a digital, por ejemplo) para conservarla en sus colecciones.  Por décadas se ha  incrementado la protección a favor de los autores y/o titulares, mientras que las garantías al acceso y la inclusión de equilibrios en el derecho de autor quedan a merced de la voluntad política.

Esta desproporción se presenta especialmente en los países en vías de desarrollo, pues los desarrollados ya han generado, en su mayoría, normas que buscan equilibrar mejor el derecho de autor. Frente a esta realidad la Organización Mundial de la Propiedad Intelectual (OMPI) está discutiendo la necesidad de implementar garantías para que bibliotecas y archivos puedan cumplir legalmente con su misión de brindar acceso al conocimiento, a la cultura, a la educación y a la ciencia, además de preservar el patrimonio cultural.

A pesar de la evidente necesidad, las discusiones son complejas: por un lado, países comoBrasil, Ecuador y Uruguay del Grupo de América Latina y el Caribe (GRULAC) evidencian ese desequilibrio en sus propuestas, mientras los países de la Unión Europea, por ejemplo, intentan bloquear mecanismos efectivos para comprometer a otros países con una solución obligatoria para las bibliotecas.

Amalia Toledo, investigadora de la Fundación Karisma y quien ha asistido a las dos últimas sesiones en Ginebra, manifestó que “la participación de la sociedad civil es una labor de veeduría en torno a las discusiones y decisiones que se desarrollan a nivel internacional, en cuanto afectan directamente el ejercicio de los derechos fundamentales de todas y todos”

La discusión internacional hace evidente que tanto los bibliotecarios como los usuarios y las directivas de las bibliotecas y archivos deben fortalecer sus conocimientos sobre derecho de autor y sobre los retos que supone la circulación de contenidos bibliográficos en el siglo XXI.

Pensando en esto, la  karisma.org.co Fundación Karism, junto con los capítulos nacionales de Creative Commons en ColombiaEl Salvador y Uruguay, se unieron para trabajar en un material dirigido a la comunidad de bibliotecas de la región. Se trata del curso en línea, abierto y gratuito internetactiva.net/cursos/abc-del-derecho-de-autor-para-bibliotecarios-de-america-latina “ABC del derecho de autor para bibliotecarios de América Latina”, una herramienta para fortalecer la comprensión de los conceptos básicos del derecho de autor, mediante ejemplos, análisis y modelos de lo abierto, con base en casos y legislaciones de países de América Latina.El material, adaptado del curso de EIFL 'Derechos de Autor para bibliotecarios’ está disponible en línea a través del proyecto School of Open  para quien quiera realizarlo en forma auto-guiada, o aprovechar las tutorías que se brindarán entre junio y agosto, a través de la plataforma internetactiva.net/cursos/abc-del-derecho-de-autor-para-bibliotecarios-de-america-latina en donde se hará su lanzamiento oficial.

Para participar en el evento de lanzamiento, deben diligenciar este formulario. Sin embargo, tenga presente que el curso NO requiere inscripción pues cada persona podrá acceder al material y realizar el curso de acuerdo a la metodología auto-guiada que se proponga.
